ATTENTION NEW YORK CITY EMPLOYERS: REMINDER TO POST IN THE WORKPLACE AND DISTRIBUTE TO ALL CURRENT EMPLOYEES WORKERS’ BILL OF RIGHTS NOTICE BY JULY 1, 2024

As we previously reported HERE, the New York City Council passed Int. No. 569-B in November 2023 requiring New York City’s Department of Consumer and Worker Protection (“DCWP”) to collaborate with the Mayor’s Office of Immigrant Affairs, the New York City Commission on Human Rights, and community and labor organizations to provide information to workers in the city regarding their workplace rights under federal, state, and local law, including those that apply regardless of immigration status and the right to organize a union.  In March 2024, the DCWP published its “Workers’ Bill of Rights” website (HERE) and a new multilingual “Know Your Rights at Work” poster, which contains a QR code linked to the website (HERE).

By July 1, 2024, employers are required to:

  • Provide a copy of the poster to all current employees and, thereafter, to new hires on or before their first day of work;
  • Conspicuously display the poster in an area accessible and visible to all employees; and
  • Make the poster available on the company’s intranet or mobile application, if such means are regularly used to communicate with employees.

Employers who fail to timely notify employees and display the poster can be subject to a $500 civil penalty, although first-time violators may avoid the fine by correcting the failure within 30 days of the first complaint.
